FREDERICK POLATSEK
Mr. Polatsek has been with the firm since 1993 and has over 31 years of exclusive practice in immigration and nationality law. Mr. Polatsek brings extensive experience in immigration law, particularly in employment-based (temporary and permanent) visas, family-based immigrant visas, naturalization, compliance, and removal matters.
Mr. Polatsek earned his Bachelor’s degree from the University of Wisconsin in 1975 and his Juris Doctorate from Brooklyn Law School in 1980. He has been licensed to practice law by the Supreme Court of the State of New York since 1981 and is also licensed in Florida.
Since joining the firm, Mr. Polatsek has practiced extensively in the preparation and processing of work-related nonimmigrant employment-based visas, including individual and blanket based Multinational Executive / Manager / Specialized Knowledge employee transfer visas (L-1 visas), Professional employment visas (H-1B, H-1B1 (Chile & Singapore), E-3 (Australia) and TN visas), Treaty Trader and Investor visas (E-1 and E-2 visas), as well as J-1, O, P, and Religious Based (R-1) visas.
Mr. Polatsek also has considerable experience related to employment based and family-based immigrant (Permanent Residence) cases including EB-1 Multinational Executive / Manager Transfer and Extraordinary Ability petitions, petitions filed by United States citizens for their foreign-born spouses, parents, children, or siblings, petitions filed by Lawful Permanent Residents for their foreign-born spouses and children, and petitions filed on behalf of abused spouses and children pursuant to the Violence Against Women Act. Mr. Polatsek also has extensive experience dealing with naturalization, citizenship, asylum, DACA, and TPS matters. In addition, Mr. Polatsek has extensive experience appearing on behalf of clients in deportation and removal proceedings before the U.S. Immigration Court. This includes motion practice, applications for bonds, and conducting hearings as well as preparing and filing briefs before the Board of Immigration Appeals.
Mr. Polatsek also has considerable experience counseling corporate clients regarding compliance with employee related immigration laws and regulations. This includes preventive audits of immigration related corporate practices as well as representation of clients who have been cited by the U.S. Department of Labor or the United States Citizenship and Immigration Service for alleged violations.
In addition, Mr. Polatsek has experience filing suits in federal U.S. district courts to challenge arbitrary and capricious governmental decisions and to challenge the timing of the government’s decision-making process.
